Torodeo Terms of Service

This is an English translation provided for convenience. The Polish version is the binding one; in the event of any discrepancy, the Polish text prevails.

These Terms define the types and scope of services provided by electronic means on the Torodeo website, the conditions for using them and the complaints procedure. We make them available free of charge before you begin using the Service, in a form that allows the content to be downloaded, reproduced and stored.

§ 1. Service provider

The service provider is the operator of the Torodeo website.

§ 2. Types and scope of services

  1. Access to the content of the Service: free viewing of published materials concerning financial and commodity markets: market observations, technical indicator readings and information about market events and trading sessions. The service requires no registration and no data whatsoever.
  2. Access to educational materials: free guides available without registration and without providing an email address.

The Service does not operate user accounts, does not accept payments and does not provide services requiring registration.

These Terms concern the Service. Content published by the service provider on social media services is additionally subject to the terms of their operators.

§ 3. Nature of the published content

Content published on the Service is informational and educational in nature. It comprises market data, technical indicator readings, technical levels derived from historical data, information about market events and educational materials.

It does not constitute an investment recommendation within the meaning of Regulation (EU) No 596/2014 of the European Parliament and of the Council, nor investment advice within the meaning of the Polish Act of 29 July 2005 on Trading in Financial Instruments. The service provider neither suggests nor proposes any investment strategy and does not indicate the timing of a transaction or entry and exit levels.

Investment decisions are taken by the User independently and at the User's own risk. See the Legal disclaimer for more.

§ 4. Conditions of service

  1. Using the Service requires a device with internet access and a web browser in a version supported by its manufacturer, with JavaScript enabled.
  2. The User is prohibited from supplying content of an unlawful nature. Prohibited in particular are actions that disrupt the operation of the Service, including automated retrieval of content on a scale that burdens the infrastructure.
  3. Use of the internet carries risks typical of that medium, in particular malicious software and unauthorised access to data in transit. The service provider makes the Service available over an encrypted connection.

§ 5. Conclusion and termination of the agreement

  1. The agreement for access to the content of the Service is concluded when use of the Service begins and terminates when the User leaves it. It requires no declaration and no registration.
  2. No financial obligations and no obligation to provide data arise on the part of the User.
  3. The service provider may discontinue the free service, in particular where the Service ceases to be operated.

§ 6. Target audience

The Service is directed at recipients within the territory of the Republic of Poland. Making the content available in other language versions is purely informational and does not constitute an offer directed at recipients in other countries.

§ 7. Complaints

  1. A complaint concerns the operation of the Service: its unavailability, malfunctioning features or non-conformity of the service with these Terms. Comments on the substance of the content, questions about the market and requests to assess a particular investment are not complaints. Other correspondence is accepted at the general address given on the Contact page, subject to the scope of matters we do not handle, as described there.
  2. Complaints are submitted to [email protected].
  3. A complaint should state who is submitting it, an email address for correspondence, the date and circumstances of the event, a description of the objections and the expected resolution. The absence of any of these elements is not grounds for refusing to consider the complaint; the service provider will then ask for it to be supplemented.
  4. A response is given within 14 days of receipt of the complaint, to the email address from which it was sent. In matters requiring further enquiry the deadline may be extended, of which the person submitting the complaint will be informed together with the expected date of the response.

§ 8. Copyright and conditions for quotation

The content of the Service, its layout, graphic marks and the name Torodeo are legally protected. The User may use the content within the scope of personal use.

We permit quotation and further publication of excerpts of the content, provided that all of the following requirements are met together:

  1. attribution to Torodeo placed directly next to the quoted content, in the same place and as visibly as the quotation itself; attribution in a footer, in a description, on a separate tab or collapsed behind a button does not satisfy this requirement;
  2. a working external link leading directly to the full content on the Service from which the quotation originates; a link to the home page or to search results does not satisfy this requirement;
  3. the link may not be hidden, nor redirected through an intermediary that conceals the destination address;
  4. the quotation may not be altered in a way that distorts its meaning, nor presented as the quoting party's own content;
  5. the extent of the quotation must remain justified by its purpose, and the material taken may not substitute for consulting the source;
  6. price forecasts, entry and exit levels and trading suggestions may not be attached to the quoted content, nor attributed to the service provider. The service provider's materials are market observations, not investment recommendations, and adding such elements changes their character.

Beyond these conditions, reproduction and dissemination of the content, in particular automated retrieval for the purpose of further publication, publication of entire materials and use of the content to train models or to power content-generating services, requires the prior consent of the service provider.

The text and data mining reservation within the meaning of Article 4(3) of Directive (EU) 2019/790 is additionally published in machine-readable form.

Breach of the above conditions constitutes use of the content without legal basis and entitles the service provider to pursue the claims provided for in copyright law.

§ 9. Personal data

The rules for processing personal data, the legal bases, retention periods and the rights of data subjects are described in the Privacy Policy.

§ 10. Amendments to these Terms

  1. The service provider may amend these Terms for important reasons, in particular as a result of a change in the law, a change in the scope or manner of providing the services, a change in technical requirements or the need to counter abuse.
  2. The amended Terms apply from the moment they are published on the Service. Use begun before publication is governed by the previous wording.
  3. The date of the last amendment appears at the end of this document. The service provider makes previous wordings available on request sent to [email protected].

§ 11. Final provisions

  1. Matters not governed by these Terms are subject to Polish law. The choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of the consumer's habitual residence.
  2. These Terms were drawn up in Polish and the Polish version is binding. Versions in other languages are purely informational. In the event of any discrepancy, the Polish version prevails.
  3. The provisions of these Terms neither exclude nor limit the liability of the service provider to the extent that such exclusion or limitation is impermissible under mandatory provisions of law, in particular liability for damage caused intentionally.
